Consumer Protection in Massachusetts Real Estate Closings

Real estate closings

ByMassachusetts law, only licensed attorneys may handle a real estate closing. Anotary who is not also a licensed attorney may not conduct a Massachusetts real estate closing.

"An Act Regulating Notaries Public to Protect Consumers And The Validity And Effectiveness Of Recorded Instrument" was signed by Massachusetts Governor Charlie Baker in October 2016. It was done with the purpose of codifying a 2004 standard of conduct for notaries.

In hisexcellent Massachusetts Real Estate Law Blog, real estate attorney Richard Vetstein explains what brought about the signing of this Act:

"In the last decade, the practice of so-called 'witness-only closings,' or 'notary closings' by non-lawyer notaries hasspread from other states to Massachusetts. This practice has been vigorously opposed by REBA which filed a successful lawsuit effectively barring the practice in REBA v. National Real Estate Information Services, 459 Mass. 512 (2011)."

New Smoke Alarm Rules for Older Massachusetts Homes

South End Boston Multi-Family homeA recent change in Massachusetts law now requires homes built before 1975 to have smoke detectors with 10-year life spans when sold.The State Fire Marshal's public education page states that some new smoke alarms come with a 10-year, sealed, non-rechargeable, non-replaceable battery. The entire alarm needs to be replaced after ten years, but thebatteries themselves never need changing during that time.In hisexcellent Massachusetts Real Estate Law Blog, real estate attorney Richard Vetstein explains changes as well as current rules in Massachusetts smoke detector regulations:

"The new rules provide thatwhen homes built before 1975 are sold, the house must be equipped with smoke detectors with a 10-year life span. These detectors are sold as 10 year sealed lithium battery power smoke alarms. They can be found at your local Home Depot or hardware store.Also remember thatcurrent rulesrequire photoelectric detectors covering the area within 20 feet of a kitchen or bathroom containing a bathtub or shower. The 10 year sealed detectors are sold with both photoelectric and the older ionization technologies..."

These bonds serve as a way of funding government operations by providing a way for the nation to borrow money.The Federal Reserve's Open Market Committeeregularly reviews the market to make decisions about interest rates, securities, and other conditions that may affect interest rates and how easy (or not) it is to get home loan financing.As Anastos explains, a shift in interest rates might be felt eithernegatively or positively depending on what it is you're looking to accomplish:

High interest rates make borrowing more expensive, so you end up paying more for home and car loans. On the other hand, your savings and money market accounts will earn higher interest. When interest rates are kept low, the opposite occurs. People earn lower interest on savings, but they can more easily borrow money.
